Terms and Conditions


1. SERVICE PROVIDER:

1.1 The terms and conditions outlined below, covers business entities operating independently, however forming part of our group of companies. Where terms and conditions are specific to an entity, it will be highlighted as such.

1.2. Terms and Conditions cover: Omni HR Consulting (Pty) Ltd and Omni Academy for ETD (Pty) Ltd, hereafter referred to as “Omni” were Terms and Conditions are generic across the entities.

 

2. CONFIRMATION OF BOOKINGS:

2.1. In the case of Open-Programmes or Public Course bookings:

  • Once a registration form has been completed and submitted to Omni, candidates will receive confirmation of their booking.
  • Omni will ensure a Training Invitation prior to the start date of the programme. The invitation will outline aspects such as: training venue (if delivered in-person), starting/ending times of the programme, requisite administration and compliance documents required for the learning intervention, together with confirming your facilitator/programme manager.
  • Training invitations will only be sent to candidates where payment confirmation has been received. Where companies are responsible for payment, a purchase order (where applicable) and/or confirmation of a payment date must be submitted to Omni.

2.2. In the case of our Academy programmes:

  • Once a registration form has been validated, welcome emails are distributed to candidates to guide them through the process of their learning journey.
  • Candidate access emails will be sent from our Virtual Learning Environment (OmniStack), prior to the commencement of their programme, with the applicable login information.
  • Candidates will receive an email from their programme lead/facilitator by way of introduction to define the programme orientation requirements before the start of the programme.


3. PRICING / PAYMENT TERMS:

3.1 South Africa – programme fee quoted excludes Value-Added Tax and will be indicated on the Quote and/or the Tax Invoice issued.

3.2 Non-SA / International – Taxes are inclusive in pricing quoted based on the exchange rate at the time of our quote being issued. 

3.3. Payment is required 24-hours before attendance of an open-programme/s or public course, unless arrangements has been made with and approved by a customer/sales representative.

3.4 Upon enrolment, a non-refundable registration fee will be payable, equating to 50% of the total programme cost, for all programmes available in Omni Academy for ETD (Pty) Ltd. The balance/remaining 50% will be due within 30-days of commencing the programme.

3.5 Business Service Level Agreements with tranche payments may be considered in consultation with a customer/sales representative for the balance of the 50% owing or our standard payment terms will apply, being the full payment to be processed within 30-days from date of invoice, with a valid purchase order (where applicable).

3.6 Omni does not provide financial aid, however, has payment partners, for individual candidates who intend on enrolling on programmes in their personal capacity.  All available payment partners will be listed on our websites.

3.7 Without prejudice to any other rights that we may have in law, we reserve the right to suspend or terminate the performance of the services or any part thereof to you immediately, at any time, with or without notice, should payment of any of our fees become overdue.

3.8 The price point quoted includes: venue cost (in-person / online), learner material/resources, assessment, moderation and external verification, in the case of formal, accredited learning.

3.9 Price exclusions: travelling, accommodation, parking and lunch (in-person training), unless otherwise specified.

3.10 We will be entitled to charge interest on all amounts outstanding, for whatsoever reason, for more than 30-days from the date of presentation of our invoice at the maximum rate allowed by law. Such interest will be calculated on a monthly basis. All payments will be allocated first as interest, then as to outlays, then to the longest outstanding fee.


4. RE-SCHEDULING OF PROGRAMMES:

4.1 A request to reschedule a programme should be submitted to Omni, in writing at least 10 business days before the commencement of the programme, and only one deferment will be allowed as dates allow.

4.2 Omni cannot be held responsible should a candidate be at a misaligned level in respect of the programme, or not have the required pre-requisite requirements as stated in the relevant programme outline. Should a candidate appear to be struggling through the learning process or feel ill-equipped to proceed with the programme, this should be escalated to the programme lead who in turn will get in touch with the candidates’ organisation to ascertain a suitable support intervention.

4.3. Omni reserves the right to reschedule, cancel or change the venue of programmes at its discretion. Should this be the case, the candidate (or company) will be advised at least 5-days in advance, via email and telephonically.


5. CANCELLATION OF PROGRAMMES RELATED TO THE BALANCE DUE AFTER DEPOSIT AMOUNT/ REFUNDS / CHARGES APPLIED TO ACCOUNT BALANCE:

5.1 All cancellations / refund requests are to be received by Omni in writing.

5.2 Refunds are only relevant to the 2nd 50% payment aligned to Academy programmes (reference 5.4 hereunder)

5.3 Candidates not arriving for a programme and have not processed a deferment within the timelines, will forfeit the 50% registration fee.

5.4 Under exceptional circumstances, refunds of any money applied for in writing will be approved on merit by the sole discretion of our Academic Team.

5.5 For international candidates, programme cancellations or refunds will be processed based on the exchange rate at the time applicable at the time of quote/invoice.

5.6. Where a payment partner has been used to fund the learning intervention, Omni will consult with the payment partner to establish the value of the funds received and whether a refund could be considered to ensure minimal financial risk to all parties concerned.


6. CANDIDATE RESPONSIBILITIES:

6.1 Omni reserves the right to exclude candidates from attending a programme due to disorderly conduct, relating to but not limited to: offensive, discriminatory language and/or behaviour.

6.2 Should candidates experience or witness disorderly or unethical conduct, they are to make the facilitator/programme manager aware of any such incidents in writing, within 48 hours of said incident. Failure to provide feedback within this timeframe will not enable Omni to take corrective action and restricts our ability to address customer service expectations.

6.3. For in-person training, candidates to dress comfortably in smart-casual attire and adhere to any specific rules and regulations of the associated training venue, in addition to any occupational health and safety requirements.

6.4. Candidates to ensure they meet the pre-requisites of a learning intervention and to ensure they have thoroughly examined the specifications and compulsory/non-negotiable requirements outlined in learning catalogues or prospectus documents provided by Omni.

6.5. Where pre-work is applicable to the learning intervention, candidates are to ensure these are completed timeously as to not impact their own learning or that of the cohort. Candidates will be escalated to their associated company/organisation should this negatively impact their ability to complete the learning intervention.

6.6. Candidates to ensure their prompt arrival for the learning intervention (in person/virtual) and the cut-off time is 30-minutes after the training has commenced, unless an arrangement for exceptional cases has been made beforehand.

6.7. Candidates to take due care of their personal belongings during training. Omni will not be held responsible for any damage or loss to personal property.

6.8. Any special needs that may prohibit learning or affect the assessment process needs to be discussed directly with the Omni facilitator/programme lead.  Omni is unable to support a candidate who does not disclose a learning barrier or choses to do so when resulting in adverse assessment decisions.


7. HOUSE-KEEPING RULES:

7.1 All programmes will be held virtually (unless otherwise stated) and scheduled based on the South African Standard Time (SAST) zone.

7.2. Where in-person interventions are held. Omni will provide the associated venue address and/or directions, which will clearly be outlined in the training invitation sent (reference: point 2 above)

7.3. Smoking will only be permissible during designated breaks allocated by the facilitator/programme lead. In the case of in-person training, candidates to establish where the allocated/designated smoking areas are.

7.4 All training programmes will have clearly communicated start/end times sent to candidates by their programme lead/facilitator.

7.5 Distractions (such as mobile phones, co-worker, family, pets, etc.) to be kept to a minimum during the training intervention, to ensure maximum benefit is received by all candidates. 

7.6. The use of electronic devices is permitted to support the learning intervention, however in the case of mobile phones, they are to be silenced during the training unless permission is received beforehand from the facilitator/programme lead (in exceptional cases) to allow a mobile phone disruption.

7.7 Materials (including, but not limited to learner material, resource guides, research papers) provided to candidates during training are subject to copyright laws and as such under no circumstance may be copied or distributed without the express written consent of the copyright holder or author.


8. CONFIDENTIALITY:

8.1 The relationship between Omni, its customers and candidates will be held in the strictest confidence.

8.2 All information (personal and company) obtained during our working relationship will be protected as far as reasonably possible and will not be disclosed to third parties in alignment with POPIA and GDPR laws.

8.3. Company specific policies, procedures, processes or intellectual property, solicited and provided to Omni by candidates, would be used for the sole purpose of building a Portfolio of Evidence and will only be used for the making of assessment decisions within the Quality Framework of our regulatory quality bodies.


9. DECLARATION:

9.1 By accepting our Terms and  Conditions you declare that:

9.1.1 The information furnished by you during your transaction with Omni is true and correct.

9.1.2 You are responsible for maintaining and updating your personal details/profile and will notify Omni of any resultant changes.

9.1.3 You accept, agree, and understand that Omni may keep and process data and documents in electronic format, including data supplied by you during your transaction with Omni, ultimately governed by POPI and GDPR laws.
